US Supreme Court limits police Google geofence warrants
Big Brother just got his knuckles rapped. The highest court in the US decided that phone location history isn't a free-for-all buffet for cops. It’s a massive win for digital privacy that actually makes sense in the 21st century.
The legal battle centered on a robbery case involving Okello Chatrie, who was convicted after police used a geofence warrant to sweep up location data of everyone near the crime scene before filtering down to him. His defense argued that scooping up thousands of innocent people's coordinates first and finding the suspect later is a blatant constitutional violation.
Under the ancient, pre-smartphone "third-party doctrine," law enforcement didn't need a warrant to grab data you voluntarily handed to companies. Apparently, back when floppy disks were peak tech, courts decided that sharing your data meant you didn't care about privacy anymore.
The Supreme Court has now declared that users have a reasonable expectation of privacy regarding their mobile location history. From now on, judges must hold police to much stricter standards, requiring concrete evidence linking the requested geographic data directly to the crime.
While critics wanted a total ban on these digital dragnets, the court chose to limit rather than outlaw them entirely, demanding much higher specificity. Meanwhile, tech giants like Google, Microsoft, Uber, and Yahoo have been inundated with these dragnet requests for years. In response, Google already started shifting location history storage directly onto users' physical devices to stop being the middleman for police surveillance.
Decades of treat-all-users-as-suspects policing are finally hitting a hard digital wall. It turns out that carrying a smartphone shouldn't automatically sign someone up for a lifetime membership in a perpetual police lineup.
